Cyberbullying

Cyberbullying is an Aggressive Intentional act of Harassment or behavior using electronic devices of digital technologies. It may be group or individual person in the virtual world. It is also known as ONLINE BULLYING or ONLINE HARASSMENT. It happens only for online social interaction. These are the lists few of them are,


• Hacking of victims account

• Online sexual Harassment

• Video games

• Texting vulgar messages and video call

• Anonymous apps to bully others

• Posting embarrassing content of pictures about victim

• Share/Uploading private information

• Send threatening messages the victim to commit an act of violence

• Access to a large online audience to encourage their peers to peers joining

• Targeting someone with gossip, rumors, and untrue stories

• Instant Message Services (Whatsapp, Facebook messenger, Instagram, viber,snapchat,tiktok,takatak,moj,Hike etc.)

• Emails

• Cyberstalking(offense done by Adults)

• Child pornography

• Tracing the location of a person through illegally

• Posting derogatory remarks online with the intent to harass

• Virtual rape

LAWS AGAINST CYBERBULLYING in INDIA


The provisions of the cyberbullying laws in India are,


• Section 67 of The Information Technology Act, 2000 prescribes punishment for publishing or transmitting obscene material in electronic form for a term imprisonment of first conviction which may extend to three years and with fine which may extend up to five lakh rupees. Subsequent conviction with imprisonment which may extend five years and also with fine which may extend to ten lakh rupees.


• Section 507 of IPC - The section states that if anyone receives criminal intimidation by way of an anonymous communication then the person giving threats shall be punished with imprisonment for up to two years. By virtue of word anonymous the offense of anti-bullying and cyberbullying is included in this section.


• Section 66 E of IT Act, 2000 - The section prescribes punishment for violation of privacy. The section states that any person who intentionally violates the privacy by transmitting, capturing or publishing private pictures of others shall be punished with up to three years imprisonment or fine up not exceeding two lakhs or with both.


• The posting of derogatory remarks under Section 500 of the IPC provides that whoever defames another shall be punished with simple imprisonment for a term which may extend to two years, or with fine, or with both.


• The Criminal Intimidation under Section 503 of the IPC on account of having made threats through emails. Section 506 of the IPC provides that whoever commits, the offence of criminal intimidation shall be punished with imprison¬ment of either description for a term which may extend to two years, or with fine, or with both. If the threat was cause death or grievous hurt, it shall be punished with imprison¬ment of either description for a term which may extend to seven years, or with fine, or with both.


• Sections 354A , 354D and 509 of the IPC provides punishment for cyber bullying and cyber stalking against women in ‘Digital Exploitation of Children', by the Ministry of Women and Child Development.
